Who we are
TRAK Fitness ("TRAK", "we", "us") makes the TRAK Fitness app for iPhone and runs trakfitnessapp.com. Contact us at trakfitnessapp@gmail.com. By using the app or the website you agree to these terms. If you don't agree, please don't use them.
Apple's licence
The app is licensed to you, not sold, under Apple's Licensed Application End User License Agreement. These terms add to that agreement. Where the two conflict, Apple's agreement applies to the licence itself.
18 and over
TRAK is made for adults. You must be 18 or older to use it. Its calorie targets, weight goals and strength standards are set for adult bodies, and the app asks your age when you first open it.
Not medical advice
TRAK provides general nutrition and fitness information for healthy adults. Calorie targets, macro splits, strength ranks, weight suggestions, meal plans and meal-scan estimates are estimates, not diagnoses or prescriptions. Speak to a doctor, dietitian or other qualified professional before making significant changes to your diet or training, particularly if you have a medical condition, a history of disordered eating, are pregnant or breastfeeding, or are recovering from injury. Stop exercising and seek help if you feel pain, dizziness or shortness of breath.
Food information
Nutrition data comes from Food Standards Australia New Zealand, the UK Composition of Foods Integrated Dataset, USDA FoodData Central and Open Food Facts, a community-maintained database. It can contain errors, and products change. Meal scan estimates foods and weights from a photo, and the result can be wrong. When a label disagrees with TRAK, trust the label.
Your data and backups
Everything you log is stored on your device, not with us, which means we cannot recover it for you. Deleting the app, losing your phone, or resetting it without a backup can permanently delete your data. Use the app's export or your iPhone backup to keep a copy. See the privacy policy for what does and doesn't leave your phone.
TRAK Premium
Premium is an auto-renewing subscription, billed yearly or monthly, sold through the App Store. Payment is charged to your Apple Account when you confirm the purchase, or when a free trial ends. It renews automatically unless you cancel at least 24 hours before the end of the current period. Manage or cancel it in your iPhone's Settings › your name › Subscriptions. Any unused part of a free trial ends when you buy a subscription. Refunds are handled by Apple under its policies; request one at reportaproblem.apple.com. Prices are shown in the app before you buy and may change, but an active subscription's price never goes up without the notice Apple requires.
Meal scan is limited to a fair daily number of scans, shown in the app, and may sometimes be unavailable.
Using TRAK fairly
Don't misuse the app or its services. That means no attempts to break, overload or get around the limits of meal scan or any other service, no reverse engineering except where the law allows it, and no using TRAK to break the law. We may suspend access to online features for anyone who does.
Our content
The app, its design, text, exercise guides and strength standards belong to TRAK Fitness or its licensors. Open Food Facts data is © Open Food Facts contributors under the Open Database License; see Open Data.
Australian Consumer Law
Our services come with guarantees that cannot be excluded under the Australian Consumer Law, and nothing in these terms limits those rights. Beyond them, and to the extent the law allows, TRAK is provided "as is", and we are not liable for indirect or consequential loss, including the loss of data you didn't back up, arising from your use of the app or the website.
Changes
We may update these terms as TRAK changes. The date at the top shows the latest version, and significant changes will be noted in the app. Continuing to use TRAK after a change means you accept the new terms.
